Il officialise une <strong>revalorisation automatique des honoraires de location<\/strong>, gel\u00e9s depuis plus de <strong>dix ans<\/strong>. D\u00e8s le <strong>1er janvier 2026<\/strong>, ces frais seront <strong>index\u00e9s sur l\u2019indice de r\u00e9f\u00e9rence des loyers (IRL)<\/strong>, impactant directement <strong>locataires<\/strong>, <strong>bailleurs<\/strong> et <strong>agences immobili\u00e8res<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une revalorisation des honoraires attendue depuis 10 ans<\/strong><\/h2>\n\n\n\n<p>Cela faisait <strong>plus d\u2019une d\u00e9cennie<\/strong> que les <strong>agences immobili\u00e8res<\/strong> r\u00e9clamaient une mise \u00e0 jour de leurs <strong>bar\u00e8mes d\u2019honoraires<\/strong>. Cette revalorisation vient enfin r\u00e9pondre \u00e0 leurs attentes, dans un contexte de <strong>hausse g\u00e9n\u00e9ralis\u00e9e des co\u00fbts<\/strong> de gestion et d\u2019exploitation.<\/p>\n\n\n\n<p>L&rsquo;arr\u00eat\u00e9 du <strong>17 juillet 2025<\/strong> pr\u00e9voit que, <strong>chaque 1er janvier<\/strong>, les <strong>honoraires de location<\/strong> seront <strong>automatiquement index\u00e9s sur l\u2019IRL<\/strong>, au m\u00eame titre que les <strong>loyers<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ce que cela change pour les locataires et bailleurs<\/strong><\/h2>\n\n\n\n<p>\u00c0 partir du <strong>1er janvier 2026<\/strong>, les <strong>honoraires \u00e0 la charge du locataire<\/strong> seront r\u00e9vis\u00e9s annuellement. Ce changement s\u2019appliquera <strong>uniquement aux nouveaux baux sign\u00e9s \u00e0 partir de cette date<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Points cl\u00e9s \u00e0 retenir :<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les <strong>honoraires de location<\/strong> \u00e9volueront en fonction de <strong>l\u2019IRL<\/strong>.<br><\/li>\n\n\n\n<li>Les <strong>plafonds l\u00e9gaux<\/strong> resteront applicables selon la <strong>zone g\u00e9ographique<\/strong> (zone tendue, d\u00e9tendue, etc.).<br><\/li>\n\n\n\n<li>Le <strong>montant factur\u00e9<\/strong> d\u00e9pendra de la <strong>surface du logement<\/strong> et de sa localisation.<br><\/li>\n\n\n\n<li>L&rsquo;<strong>\u00e9tat des lieux<\/strong> reste plafonn\u00e9 s\u00e9par\u00e9ment \u00e0 <strong>3 \u20ac\/m\u00b2<\/strong>.<br><\/li>\n\n\n\n<li>Les locataires peuvent <strong>demander un justificatif<\/strong> ou une <strong>fiche de calcul<\/strong> lors de la signature du bail.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ce que cela implique pour les professionnels de l\u2019immobilier<\/strong><\/h2>\n\n\n\n<p>Pour les agences immobili\u00e8res, cette <strong>indexation automatique<\/strong> n\u00e9cessite une <strong>mise \u00e0 jour rapide<\/strong> de leurs pratiques d\u00e8s <strong>l\u2019automne 2025<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00c0 pr\u00e9voir :<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Actualiser les bar\u00e8mes<\/strong> d\u2019honoraires.<br><\/li>\n\n\n\n<li>Pr\u00e9parer des <strong>supports p\u00e9dagogiques<\/strong> pour expliquer le mode de calcul aux clients.<br><\/li>\n\n\n\n<li>Une <strong>hausse moyenne de +13 %<\/strong> est estim\u00e9e pour la premi\u00e8re application en 2026.<br><\/li>\n<\/ul>\n\n\n\n<p>Cette \u00e9volution est per\u00e7ue comme une <strong>avanc\u00e9e majeure<\/strong> pour les professionnels, leur permettant de <strong>mieux absorber l\u2019inflation<\/strong> tout en maintenant la <strong>qualit\u00e9 de service<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Exemple : calcul des honoraires en 2026<\/strong><\/h2>\n\n\n\n<p>Prenons l\u2019exemple d\u2019un <strong>logement de 50 m\u00b2<\/strong> en zone tendue. Aujourd\u2019hui, les honoraires sont plafonn\u00e9s \u00e0 <strong>13 \u20ac\/m\u00b2<\/strong>, soit <strong>650 \u20ac<\/strong>.<\/p>\n\n\n\n<p>Avec une revalorisation de <strong>+13 %<\/strong> en 2026, les honoraires pourraient s\u2019\u00e9lever \u00e0 environ <strong>735 \u20ac<\/strong> (hors \u00e9tat des lieux).
